Terms and Conditions for Bathroom Renovation Services
1. Scope of Work
The Contractor agrees to provide the following services for the renovation of the Client’s bathroom:
- Demolition: Removal of existing fixtures, tiles, plumbing, and electrical systems.
- Plumbing and Electrical: Updating or installing new plumbing and electrical systems as required.
- Installation: Installation of new fixtures, tiles, vanities, mirrors, lighting, and other items as per the Client’s specifications.
- Finishing: Tiling, grouting, and painting.
Exclusions: The Contractor is not responsible for any additional work not outlined in the Scope of Work, such as structural repairs, landscaping, or interior decoration not related to the bathroom renovation.
2. Project Timeline
- The estimated timeline for the completion of the renovation is [X weeks/months], commencing on [Start Date].
- The Client understands that delays may occur due to unforeseen circumstances, including but not limited to material shortages, weather, or changes in project scope.
- The Client agrees to promptly approve any changes to the timeline caused by unforeseen delays.
3. Payment Terms
- Total Cost: The total agreed price for the renovation, which includes labour, materials, and permits.
- Deposit: A non-refundable deposit of 50% of the total cost is due upon signing the contract.
- Progress Payments: Progress payments will be made based on completed milestones. Payments are due as follows:
- First milestone – 30% of the total cost.
- Second milestone – 20% of the total cost.
- Final Payment: The remaining balance will be due upon completion and final inspection of the work, before the Client signs off on the completed renovation.
- Late Payment: Any late payments will incur an additional charge of 5% per day.
4. Change Orders
- Any changes to the original scope of work must be agreed upon in writing by both the Contractor and the Client.
- The Contractor will provide a written estimate of the cost for any additional work, and the Client must approve it before work proceeds.
5. Permits and Approvals
- The Contractor will be responsible for obtaining all necessary permits required for the renovation (e.g., plumbing, electrical).
- The Client is responsible for ensuring the property is compliant with local zoning and building regulations.
6. Access and Responsibilities
- The Client must ensure the property is accessible to the Contractor and any subcontractors during agreed-upon working hours.
- The Client must remove any personal items, furniture, or valuables from the work area before the start of the renovation.
- The Contractor will take reasonable precautions to protect the Client’s property and surrounding areas but is not responsible for any damage not caused by the Contractor’s actions.
7. Client Responsibilities
- The Client is responsible for making timely decisions on design choices, materials, and fixtures to avoid delays in the project.
- The Client agrees to promptly address any requests from the Contractor for approvals or additional information.
8. Warranty and Guarantees
- The Contractor warrants that all work will be performed in a professional manner and comply with industry standards.
- A warranty of 5 years is provided on labour and installation, covering defects in workmanship.
- Manufacturer warranties for materials and fixtures are separate and subject to the manufacturer’s terms.
- The warranty does not cover damage caused by misuse, wear and tear, or alterations by the Client or third parties.
9. Insurance and Liability
- The Contractor carries general liability insurance and workers’ compensation insurance for the duration of the project.
- The Contractor is not liable for any damage to the Client’s property or injury to persons caused by the Client’s failure to maintain the worksite after project completion.
10. Termination
- The Client may terminate this Agreement with written notice before work begins but will forfeit the deposit.
- If work has already commenced, the Client may terminate the Agreement, but is liable for payment for all work completed up to that point.
- The Contractor may terminate the Agreement if payment terms are not met, or if the Client fails to comply with the terms of this Agreement.
11. Dispute Resolution
- Any disputes arising from this Agreement will first be attempted to resolve through informal negotiation.
- If a resolution cannot be reached, both parties agree to use mediation or arbitration before seeking legal action.
12. Force Majeure
- Neither party shall be held liable for delays or failure to perform due to causes beyond their reasonable control, including but not limited to natural disasters, strikes, or government restrictions.
13. Governing Law
- This Agreement will be governed by and construed in accordance with the laws of the state of TG, and any legal proceedings will be conducted in the courts of HYD.
